An opposing party generally has no legitimate interest in the appointment or removal of a litigation guardian, whose duties run to the party represented and who is answerable to that party. An opposing party also lacks standing to police the ethical obligations of the other side's solicitors, whose duty is to the court and professional disciplinary bodies. Applications to remove litigation guardians or restrain solicitors based on speculative future conflicts will be refused where no defence has been filed and the issues in the proceedings are not yet defined.
