A mature adult who commits a deliberate, protracted and unprovoked assault occasioning bodily harm, particularly where the attack continues after the victim is rendered unconscious, should usually expect a sentence involving actual custody. Post-sentence evidence of counselling for anger management and depression arising from the consequences of offending (rather than remorse) is unlikely to be admitted on appeal or to demonstrate that a sentence was manifestly excessive.
