An error by the President of the Industrial Court in construing s 32 of the Workers' Compensation and Rehabilitation Act 2003 (Qld) is an error within jurisdiction, not jurisdictional error, because the interpretation of substantive provisions of the WCR Act is committed to the Industrial Court's jurisdiction on appeal under s 561. The privative clause in s 349(2) of the Industrial Relations Act 1999 (Qld) therefore precludes judicial review of such errors. The reasonable management action exclusion in s 32(5) may extend to management of one employee's complaints about another employee's bullying, where the management action is connected with the complaining employee's employment.
