Where final distribution of an estate is imminent, a court will not order the removal of executors even where allegations of misconduct are made, because removal would inevitably delay distribution and any loss can be remedied by proceedings after distribution. Indemnity costs may be awarded where the pursuit of such an application on appeal is unreasonable.
