An extension of time for a Crown appeal against sentence requires both a satisfactory explanation for the delay and exceptional circumstances justifying exposure of the respondent to double jeopardy; an arguable error of law in the sentencing process is not, without more, sufficient. Where Commonwealth child pornography offences involve use of a carriage service, the State offence of mere possession is not an equivalent charge and the State maximum penalty should not fix the relevant maximum for sentencing.
