Where evidence before the court on an application for appointment of statutory trustees for sale under s 38 of the Property Law Act 1974 (Qld) discloses a real dispute as to beneficial interests in the property, it is precipitate to make a final order distributing net proceeds according to registered title proportions. The court may instead order partial distribution and preserve a fund pending resolution of the beneficial ownership dispute.
