The norm for the period to be served before recognizance release for Commonwealth offences is 60-66% of the head sentence, and a sentence well outside that range requires most unusual justification. The customary discount on the recognizance release date for future co-operation under s 21E of the Crimes Act 1914 (Cth) ranges from 20 to 50 per cent. On a Crown sentence appeal, the court will apply caution and is bound by the prosecution's submission below as to the appropriate pre-release period.
