An adjudicator's decision under the Building Construction Industries Payments Act 2004 (Qld) does not give rise to res judicata or issue estoppel so as to preclude a company from raising a genuine dispute or offsetting claim in an application to set aside a statutory demand under s 459G of the Corporations Act 2001 (Cth). Section 100 of BCIPA preserves the right to raise such disputes. The terms of BCIPA cannot constrain the operation of the Corporations Act.
