Section 22 of the Land Sales Act 1984 (Qld) requires rectification only of the s 21(1) particulars (lot identification, names, addresses, representations about certificates of title), not of all information contained in a combined disclosure document that also satisfies s 213 of the BCCM Act. Where a contract permits variation in lot size by a specified percentage, the floor area in the disclosure statement is to be read subject to that tolerance, so that changes within the permitted range do not render the statement inaccurate for s 22 purposes. A vendor's assertion of an incorrect view of the settlement date based on a disputed interpretation of s 22 does not necessarily constitute anticipatory breach.
