The mandatory minimum non-parole period prescribed by s 32(5)(ba) of the Criminal Law (Sentencing) Act 1988 (SA) operates as a benchmark representing the appropriate non-parole period for an offence at the lower end of the range of objective seriousness, not as an absolute minimum. 'Special reasons' under s 32A(2)(b) means sufficient reasons, not exceptional or extraordinary reasons. Cooperation with police that is accompanied by a false exculpatory account will be assessed in that light and may be found to be of little significance. The provisions are constitutionally valid and do not impermissibly discriminate between offenders who plead guilty and those who plead not guilty.
