A de facto life partner of approximately 30 years who provided significant care to the deceased is entitled to provision of a residence absolutely (not merely a life interest) and a nest egg, even where the estate must also provide for the deceased's children. Speculative prospects of obtaining property through Family Court proceedings against an estranged spouse are given little weight in assessing the applicant's financial resources. The provision of 43.38% of the estate was appropriate in these circumstances.
