Where a presentment charges both maintaining a sexual relationship with a child under 16 and separate substantive counts covering the same acts and period, the relationship count must be quashed (applying GJB). However, resentencing on the remaining individual counts may produce the same total effective sentence where the sentencing judge's assessment of criminality on the relationship count was equivalent to that constituted by the individual counts. A prior history of childhood sexual abuse may serve little by way of mitigation depending on the circumstances.
