A worker's lack of awareness that they have a cause of action arising from workplace injuries is irrelevant to the time bar under s 135AC(b) of the Accident Compensation Act 1985. The three-year limitation period runs from when the worker knew facts which, viewed objectively, constituted serious injury incapacity, regardless of whether the worker appreciated the legal significance of those facts or had consulted a solicitor.
