Where a conspiracy to steal count names multiple property owners, the naming of those owners provides particulars identifying the area of the conspiracy and does not require the prosecution to prove an agreement to steal from each named owner. The agreement to steal is the actus reus; the identity of the owners is a particular, not an element of the offence. R v Maria [1957] St R Qd 512 is distinguishable where the Criminal Code charge specifically alleged an agreement to obtain money from two named persons by fraudulent means.
