A sentence of 12 months' imprisonment for driving while under suspension was excessive where the offender had mental health issues (bi-polar condition) and the previous penalty for the same offence had been a community-based order. An appropriate sentence in those circumstances was 8 months. Pre-sentence custody must be taken into account and reflected in the warrant of commitment.
