The vulnerability inherent in being a sexual assault complainant is already reflected in the customary sentencing range, so a complainant's intellectual disability does not necessarily take the case outside the ordinary range. The circumstance of aggravation of ejaculating on the complainant's body, while distressing, does not significantly aggravate overall culpability in the context of the already serious offence of sexual penetration without consent.
