The offence of threatening to kill under s 338B of the Criminal Code (WA) does not require proof that the recipient was actually placed in fear of being killed. The test is purely objective: whether the words used, in the circumstances in which they were spoken, constituted a declaration of an intention to kill. A trial judge is not obliged to direct the jury to consider the effect of the threatening words upon the recipient.
