The post-transitional sentencing range for armed robbery in Western Australia is 4 to 6 years' imprisonment, not 6 to 9 years. A sentence of 3 years' imprisonment for aggravated armed robbery in company involving weapons used aggressively is not manifestly excessive where it reflects a guilty plea and mitigating factors. Non-compliance with s 8(4) of the Sentencing Act 1995 (WA) — failure to state in open court that a reduction was made for a guilty plea — is not an appellable error and does not invalidate the sentence.
