Section 45(1) of the Insurance Contracts Act 1984 (Cth) avoids only that part of an 'other insurance' clause which has the stipulated effect of limiting cover by reference to contracts entered into by the insured as a party; the remainder of the clause may be severed and remain valid. In cases of double insurance, only the insurer who indemnifies the insured obtains a right of subrogation; a co-insurer who subsequently pays contribution does not acquire subrogation rights. Where a judgment requires two parties to indemnify a third, payment by one discharges the other's obligation to indemnify, and the question is determined by reference to the judgment rather than the underlying causes of action.
