The test for where a worker 'usually works' under s 36B(3)(a) of the Workers Compensation Act 1951 (ACT) is a factual inquiry into where work is actually performed, not where the employer requires it to be performed. Where a worker usually works in more than one jurisdiction, the sequential tests in s 36B(3)(b) and (c) must be applied. A worker's home office does not necessarily constitute a 'usual base' for employment purposes under s 36B(3)(b); something more than a convenient place for part of the worker's duties is required.
