The correct question for patent infringement is whether the allegedly infringing product contains all the essential integers of the claim, not whether the claim contains all the integers of the product. The presence of an additional integer in the allegedly infringing product does not avoid infringement unless it creates a new working of the combination that materially affects how the claimed invention works. Preferred embodiments in a specification do not narrow the invention where the consistory clause matches the claim terms.
