Section 8(10)(b) of the Safety, Rehabilitation and Compensation Act 1988 (Cth) applies to the calculation of normal weekly earnings even where the employee's project-specific or fixed-term employment has ceased upon completion of the project or effluxion of time. The hypothetical exercise required by s 8(10)(b) directs the decision-maker to assume that the employment continues notwithstanding the occurrence of a terminating event, but the terms and circumstances of the actual employment (including the expiry of site-specific agreements and completion of the project) must be taken into account in determining what the employee would have earned in that hypothetical continuing employment. The word 'employment' in s 8(10)(b) is not limited to the employee's generic trade or classification but encompasses the actual terms and conditions of engagement.
