Where a party attempts to draw defendants back into litigation through an amended draft notice of appeal in proceedings that do not concern those defendants, and all prior avenues of appeal from the judgment in those defendants' favour have been exhausted, the court will dismiss the proceedings as against those defendants and order costs.
