A party seeking the indulgence of re-opening an appeal should be prepared to justify the application on the basis of material already in their possession, without the assistance of subpoenas. The court may formalise interlocutory directions in a judgment to enable review under s 46(4) of the Supreme Court Act 1970 (NSW).
