Section 63 of the Civil Procedure Act is available to validate irregularities arising from non-compliance with UCPR Pt 51 r 9, even where the time for compliance has expired and the rule does not itself permit extension. UCPR Pt 51 r 50 (security for costs in special circumstances) applies only to appeals, not to applications for leave to appeal, though the special circumstances threshold may inform the exercise of discretion under the general rule in Pt 42 r 21.
