A Calderbank offer requiring withdrawal of an entire appeal is not unreasonable to reject where the appeal raises an important undecided point of law, even if other grounds of appeal are weak. Grounds of appeal that are ultimately dismissed as raising factual questions do not necessarily warrant indemnity costs where there was an arguable basis for the appellant's position, particularly where prior authority supported the appellant's contention.
