A development consent that uses the plural 'plans' in its general conditions may be construed as permitting staged subdivision, with the result that conditions relating to residue lots do not need to be fulfilled until the residue lot is itself the subject of a plan of subdivision. Courts will decline to make declarations about the construction of development consent conditions where the obligation relates to a future uncertain event, the form of the declaration is deficient, and not all affected parties are before the court.
