Section 26C of the Civil Liability Act 2002 (NSW) precludes recovery of aggravated damages by offenders in custody who do not meet the 15% permanent impairment threshold, because aggravated damages are a form of compensatory general damages. However, exemplary damages are not precluded by s 26C, and an offender in custody may maintain a claim for exemplary damages even where the impairment threshold is not met. The Court noted there are other cases that will turn on this outcome.
