An executor's duty to uphold the terms of a will is a duty to be performed in the litigation and does not prevent the executor from encouraging or supporting a family member's Family Provision Act claim. The duty does not override normal parental or familial duties to children needing advice about their rights and assistance in enforcing them. A finding of improper motive that was never put to a party in cross-examination cannot support a costs order.
