A trial judge cannot determine a critical liability issue solely on the basis of accepting one witness's demeanour where there is a complex of contradictory evidence from multiple witnesses and contemporaneous documents that has not been analysed. Where critical evidence emerges for the first time in cross-examination and is absent from prior statements and contemporaneous reports, the trial judge must examine all surrounding circumstances before accepting it.
