Leave to appeal from the District Court to the Court of Appeal will be refused where the issues are unexceptional questions of fact or mixed fact and law, no issue of principle or general public importance arises, there is no obvious injustice, and the amount involved is well below the $100,000 threshold for appeal as of right. An unpleaded issue that is litigated at trial without objection may be determined by the trial judge.
