An offer by an impecunious individual to personally guarantee the costs of an impecunious corporate plaintiff does not defeat an application for security for costs under s 1335 of the Corporations Act 2001 (Cth); such an offer is merely a factor in the exercise of the discretion. The position of an individual co-plaintiff is not analogous to that of an impecunious guarantor. Where the co-plaintiff's case is not co-extensive with the corporate plaintiff's case, the presence of the co-plaintiff carries less weight against ordering security.
