For the purposes of s 51 of the District Court Act 1973 (NSW), the 'amount claimed' is not limited to what appears in the statement of claim and may be ascertained from particulars provided to the defendant. The adequacy of disclosure is assessed from the perspective of the intended reader (typically the defendants' professional advisors). Particulars need not be provided contemporaneously with the commencement of proceedings but must be given a sufficient time before the three-month pre-trial period to allow the defendant a reasonable opportunity to object.
