The standard non-parole period under Division 1A of Part 4 of the Crimes (Sentencing Procedure) Act 1999 defines the non-parole period for an offence in the mid range of objective seriousness, not the total term. A sentencing court has no power to impose conditions on parole where the total sentence exceeds 3 years. While an offender's intellectual disability reduces the significance of general deterrence, it does not render general deterrence entirely inappropriate where the offender understood the wrongfulness of his conduct. The availability of post-sentence supervision or detention orders under the Crimes (Serious Sex Offenders) Act 2006 cannot be taken into account as a mitigating factor.
