The Pearce v The Queen prohibition against double punishment does not require a sentencing judge to constrain the sentence for an elected offence to the jurisdictional limit applicable to a related offence arising from the same facts. The correct approach is to sentence independently for each offence and avoid double punishment through appropriate orders for concurrent service. The 25 per cent discount for an early guilty plea at the earliest opportunity, as postulated in R v Thomson, was applied.
