The question whether the Crown ought reasonably to have foreseen the need to call further evidence is not a separate second stage in the test for reopening the Crown case, but rather one circumstance (which may itself be determinative) to be weighed in the overall assessment of whether the circumstances are very special or exceptional. The proviso was applied where the appellant was able to call his own expert in response and the Crown evidence was otherwise compelling.
