Evidence of deterioration in a family member's mental health after sentencing, where that deterioration was predicted by evidence before the sentencing judge, does not constitute 'special' or 'unusual' circumstances warranting admission of fresh evidence on a sentence appeal. The threshold for exceptional hardship to an offender's family requires hardship sufficiently extreme to go beyond the sort of hardship which inevitably results when a breadwinner is incarcerated, and the availability of support mechanisms (psychiatric referral, psychological support, family support agencies) is relevant to that assessment.
