In sentencing for dangerous driving causing death, the number of deaths is not relevant to the assessment of moral culpability of the driving, but the number of persons put at risk by the driving (including passengers) is an aggravating factor going to moral culpability. A sentencing court must not reduce a sentence to enable a juvenile offender to remain in a juvenile facility rather than being transferred to an adult prison upon turning 21. Psychiatric evidence of adolescent brain immaturity does not mitigate grave driving offences committed by persons old enough to hold a driver's licence.
