The prosecution's duty of disclosure does not extend to material supporting a defence theory that was never actually advanced by the accused in evidence, even where counsel speculated about such a theory in submissions. The existence of a possible parallel conspiracy does not logically exclude participation in the charged conspiracy. Where a trial judge's directions contain errors but the evidence of guilt is overwhelming, the proviso under the Criminal Appeal Act 1912 may be applied.
