A single co-executor may defend Family Provision Act proceedings and bind the estate without joinder of all co-executors. An applicant's legal incapacity and lack of legal advice may constitute sufficient cause for extension of time under s 16(3) of the Family Provision Act 1982 (NSW). Where a testamentary gift adeems due to the deceased's change of property, the court may designate the replacement property as notional estate and make provision including a Crisp order with remainder interests to protect other beneficiaries' expectations.
