A vexatious proceedings order under s 6(2)(b) of the Vexatious Proceedings Act 2005 (Qld) does not preclude the person subject to the order from appealing against that order without first obtaining leave. The statutory definitions of 'proceedings' and 'institute' must yield to context under s 32A of the Acts Interpretation Act 1954 (Qld), and the context indicates that the legislature did not intend to immunise vexatious proceedings orders against appeal. The proper form of a s 6(2)(b) order should expressly exclude appeals against the order itself from the prohibition.
