An applicant's illiteracy is a relevant factor in assessing whether to grant an extension of time to appeal. Complaints about deficiencies in legal representation at trial, even if unsupported by evidence at the extension stage, may support an extension where they have the potential to contribute to a miscarriage of justice. The Court may extend time even where the explanation for delay is not especially compelling, provided the prosecution case was not apparently overwhelming and the interests of justice favour allowing the appeal to proceed.
