The fact that a co-accused was charged with the same offence (either as principal or party) and acquitted does not establish that the co-accused's exclusive responsibility was necessarily a reasonable possibility requiring the appellant's acquittal. The court's function remains to examine the whole record to determine whether the evidence against the appellant lacked probative force such that there is a significant possibility an innocent person was convicted.
