On an application to renew a claim under UCPR r 24(2), the correct standard for assessing the merits of the claim is whether it is 'apparently worthwhile', not whether it has 'substantial prospects of success'. However, it is not an error for a court to consider the strength of a plaintiff's claim where it is possible to do so. The destruction of a defendant's file notes and the passage of substantial time since the relevant events may constitute prejudice sufficient to refuse renewal, even where the plaintiff has provided a reasonable explanation for delay.
