Section 21 of the Land Sales Act 1984 (Qld) requires only that a proposed lot be clearly 'identified', not that it be precisely described with dimensions or metes and bounds; identification by lot number, building location, floor level, and reference to annexed plans and elevations is sufficient for off-the-plan sales. The 'substantially complete' requirement in s 213(4) of the BCCMA applies to the disclosure statement as a whole, not to each individual item required to be included. The exception to retrospectivity in s 362A(3)(b)(i) of the BCCMA applies only where a contract was lawfully cancelled specifically because of non-compliance with former s 212(1), not where cancellation was expressed to be under other provisions. The question whether the Shepherd v Felt & Textiles principle (that justification need not have been known at the time of action) applies to statutory cancellation rights under the BCCMA was left open.
