The power under s 3.5.11 of the Integrated Planning Act 1997 (Qld) to approve a development application in part is unqualified and not subject to the 'minor change' limitation in s 4.1.52(2)(b). The two sections deal with different subject matters: s 3.5.11 concerns partial approval of applications, while s 4.1.52(2)(b) concerns applicant-initiated changes to applications. The P&E Court, when hearing an appeal by way of hearing anew, stands in the shoes of the assessment manager and has the same unqualified power to approve in part. However, whether partial approval is appropriate in a given case remains a question of fact, particularly where the development is 'integrated'. The P&E Court also has power to adjourn hearings to allow further evidence to be obtained on unresolved issues such as traffic impacts.
