Under BCIPA, a claimant may serve a subsequent payment claim for an amount that was the sole subject of a previous payment claim, provided the subsequent claim relates to a different reference date and there has been no valid adjudication determination of the earlier claim. Section 17(6) does not require that a previously claimed amount be accompanied by an additional new claim. Section 32 exhaustively defines rights to a new adjudication application on the earlier payment claim but does not preclude making a fresh payment claim under a different reference date. Doolan v Rubikcon is no longer to be followed on this point in Queensland.
