An agreement between the RSPCA and the State allocating areas of primary enforcement responsibility does not constitute a limitation on inspector powers under s 116 of the Animal Care and Protection Act 2001 (Qld). Section 205 of the ACP Act provides for appeals against Magistrates Court decisions on review of Chief Executive decisions (ss 203-204), not for appeals from summary criminal proceedings, which lie under s 222 of the Justices Act 1886 (Qld). A forfeiture order under s 182 of the ACP Act vests property immediately in the absence of statutory provisions to the contrary.
