Assertions in extradition materials based on information received from foreign law enforcement agencies do not constitute admissions against interest by the Crown where the Crown has not purported to affirm or acknowledge the truth of those assertions. The purpose of extradition documentation is to show sufficient evidence to justify prosecution, not to define the evidentiary limits of the case. The place of procurement or loading of drugs is not an element of a conspiracy to import offence for the purposes of the speciality provision in s 42 of the Extradition Act 1988 (Cth).
