Issue estoppel, including the extended Anshun principle, applies to adjudication determinations under the Building and Construction Industry Payments Act 2004 (Qld). Where an adjudicator rejects a claim for want of evidence or failure to demonstrate entitlement, the claimant is precluded from re-agitating that claim in a subsequent adjudication. The court may grant injunctive relief to restrain service of an adjudication application in respect of re-agitated claims, as there is no mechanism before an adjudicator for dismissal or stay on grounds of issue estoppel.
